Questions?? "Vintage" Futaba FM 40Mhz

I have a 20+ year old Futaba FP-T2PDF MEGATECH FM transmitter with FP-R103FM (40Mhz frequency 40.650) in very nice condition. It was purchased in Japan, not imported to the US.

Can it be used with today's brushless motor/ESC/1S lipo batteries?

I don't think it would be a problem with that but don't believe it would be legal in the USA. 40 Mhz wasn't back in the day and that's why it was never imported here. Probably other electronics are using this frequency now days.

It was a frequency that was only used outside the USA but don't know what it may be used for now days over here if anything. Hopefully not commercial airlines! (cell phone etc...)

I got this radio while stationed in Okinawa, Japan. I bunch of us Marines ran Kyosho GP10 4wd (2-speed transmission) gas powered on road cars in the enlisted club parking lot on weekends. Still have the car (in need of restoration).
