Maybe it's just me but it seems that putting the first gear spur the same height as the bottom of the chassis is asking for trouble. I'm sure most people will find scratches on the bottom of their chassis so you'll run the risk of the spur gear touching the ground. After some testing, i'm guessing that will change.
Many modern cars have the first gear at the same height as the bottom of the chassis, Xray NT1 for example, and haven't heard of anyone having issues chipping teeth or damaging spurs.
The reason why the entire 2-speed axle assembly is lower is because Capricorn changed the spur/pinion ratio which allows them to use much smaller diameter gears.
