Probaby not. But if you check the packaging of many food and drink products in California, you'd find many of those companies haven't either.
Off topic but companies can get fined for not disclosing prop 65 warnings. However there is not a governing body to dictate if a prop 65 warning is needed. Thus there is a number of companies applying warnings that are not needed.
