I believe ur allowed one back up copy if u own the game on a physical disk store bought copy. so really its not piracy until that person gives it to someone else. And keeps only one of the disks

And what good would that do when Microsoft has no legal way for you to play that backup? Why would MS keep doing dashboard updates that attempt to eliminate the ability for flashed drives to play backups? You'd be buying a coaster, or a pirated game. This 'personal backup' argument is tiresome, everyone knows what's going on - stealing software.

If the original poster can post a verified pic of HIS original copies of "any game"... which of course won't happen... again, it's piracy.

The buyer need the store bought copy too and $12.00 is nut going rate is $ 4.00 for back ups now i have all the old real games and i back all my games to copys and play them only too save the real game. and would never sell them too so it is piracy the seller and buyer must have the real game too have a back up copy

I don't know if it's true if you can copy a game for your own use. But, copying and selling them is against the law.

When addressing the legality of copying any electronic form of intellectual property, there is always debate. Whether talking about music, movies or games, manufactures fight to protect their copyrights, individuals fight to protect their investments and the reality of illegal piracy makes finding a mutually beneficial solution nearly impossible.

Typically, the public looks to the Fair Use Act and the Audio Home Recording Act of 1992 to define their rights. Though open to interpretation, in a nutshell, these Acts say that you may legally make a copy for personal backup purposes, e.g. with game copying software, if you were the one who bought (and still own) the original.

This backup/archival copy exception is a very narrow limitation relating to a copy being made by the rightful owner of an authentic game to ensure he or she has one in the event of damage or destruction of the authentic game, not for the purpose of acquiring financial gain.

So if I own a sports car, I'd be entitled to buy a second one for pennies on the dollar just in case I wreck the first - with the manufacturer making nothing on the product they spent all the time on?

This is still piracy.

Buy one of something, don't be careless with it. Buy a second if you need another. Don't be a thief, or a cheapskate.
