Default Selling modded motors? Think again!

Tuners who are modifying Novarossi based motors and resell them will have action taken against them. Here is the quote on Novarossi's webpage and you can email them direct and they will email you back promptly.

"Dear Customers,
we inform you that Novarossi highly forbid to anybody, any kind of modifications to their engines and/or to any engine's part. Since now Novarossi will take proper actions against any breaker in any country and in the more convenient ways."

It does not say anything about selling them

I bought the engine with MY money, it is MY engine, why cant i do whatever i want with it?

Yea...whatever...if I want to port my engine guess what....I will port my engine. Good thing living in the USA...its alittle thing we like to cal FREEDOM.

This paragraph is actually legally unenforcable. Engine modifiers cannot copy the motors workpapers and sell them and also cannot reverse engineer the motors. This is standard international copyright law.

However you cannot copyright an engine design, for this you need a patent.

Even if you have a patent you cannot stop anybody from modifying your product once it is distributed.

Case in point the sony playstation. Sony was trying to stop people modifying their PS1 units with chips so they can play illegally burned games. Several courts in several jurisdictions found people can do what they like with a product that they bought (ie. mod them) but it was completely illegal to use copied software that you did not own a proper version of.

Say WHAT!!!!!!! I really do not think that they could inforce that, thats like one of the big three car makers telling people that they have to bring there cars to them for up grades and if they do not then they wold bring copy right charges against them. I was looking at there web page but I was not albe to find the info that you were talking about, were on the site did you see this?

I don't see someone modifying an engine then selling it any different than the smaller electric motor companies that buy motor blanks from reedy, trinity, or orion then using different springs, brushes, different wire, etc.. and selling it under their name as long they don't claim they designed it. Like AMGRacer said, that product is YOURS and you don't own the design of it but if you change it you are essentially creating your own design or could patent that if that makes sense.

Like all box-stock motors, Nova's need their potential developed by "tuners", like JP Calendreau (JP Racing), Massimo Fanitini (NovaMax), and so on... And they know it. Try to race a stock RX21 Race against a JP Race! That's why they SELL a lot of their motors to "tuners"... The day when JP doesn't tune Nova's anymore, but decide to work on Sirios for instance, NovaRossi's profits will plummet in a few weeks...

Sorry to burst your bubble my friend, but it doesn't really matter whether you live in the US or not, it has nothing to do with freedom of any kind... You don't reall need to live inalmighty America to dremel your motor's sleeve and crank anyway...

Guys,

I think this is to target modifiers that do this for money, like Richey did and now Murnan and a couple of others are.

I guess once you are trying to put your name on it, it becomes different.
