Had the same problem with a GTX where the esc had no brake. Returned it to Novak under warranty and they replaced the unit.

If under warranty - send them back. If not, the one that has no brake probably blew the internal shotky diode. Add an external one to see if it helps. The lack of brake could also be a set-up problem on your radio where you may have trimmed it out. If your controller has the provision, check to make sure your brake settings on your controller are at 100 when you set-up the speed-controller.

YA but speaking with novak that there is a 120 day warranty on the esc even if it is refurbished

I have done the refurb thing from Novak on quite a few things and never had any issues with what they sent me. You get the same warranty on the refurb as a new one at most times less then half the price. Good program if you ask me and I plan on sticking with Novak because of it.
