I'm a little surprised you sent him any more money. I know you were hoping for the best and just trying to get YOUR stuff back. But this guy has already rationalized to himself why the buggy is now his. This guy is a true thief IMO. Good luck getting your stuff back.

I did say i would pay for it to be shipped back, so yes i did pay him some more money but i did it through Paypal. It seams he is MIA for a couple days at a time, which makes no sense.

it's not a police matter. this is a civil dispute.

I would let the police decide that. Are you a lawyer or a cop?

Ya i like how he has nothing to say now that he has money and buggy in hand now....at least you have a paper trail now that he accepted the money back for shipping the buggy back.

i have experience in these areas.

let's just see what his buddy's girlfriend's uncle's best friend's cousin's parents say when he contacts them. pretty sure it'll be something like, "that's civil. take him to court." however, if the buyer keeps the $50 that the seller sent him for return shipping and doesn't ship the buggy, then it could be argued that the situation with the $50 is crossing into the criminal arena, but even that's a tough sell as it doesn't sound like there was ever an agreement on that.

the bottom line is that these guys entered into a contract, with each other as well as paypal. if it's true that paypal has a rule about non-response to a dispute where the person who opened the dispute gets to keep the $ and the merchandise, then seller's beef is with paypal. yeah, in a gentleman's agreement it's a slimy thing to do (keep the buggy), but it doesn't constitute theft. there is no intent to defraud. he's following the rules of paypal. i can't believe paypal has this rule and believe that if seller states his case, eventually paypal will make buyer send buggy back.

i have a sneaking suspicion that the buyer has been running this buggy since he got it and is hesitant to ship it back in it's current condition.

Lol, I have also seen cops that don't mind teaching a kid a lesson in morals and responsibility. I could give an example of one guy who was jerking a buyer around, Cop took it upon himself to start rousting the guy after being alerted to him lol. A totally different state lol. About once a day lmao. It didn't take long before the truck was shipped, so I also have experience in these things lmao. Some of these "lessons" I have personally witnessed lol. Nothing like watching some punk, trembling while being confronted by a cop or detective.

Eta I would like to see PP's statement that the seller forfeits the merchandise on non responce.

cops are not debt collectors. i would caution any police officer who would think about "rousting" a guy over a civil dispute. quick way to a disciplinary hearing.

Lol, cops rousting someone isn't new lol, on what you claim is a civil matter. You might want to hop over and spend some time on CopBlock, you'll see that's true. Frankly people break laws everyday, whether they know it or not. I would be willing to bet Sprout broke at least one here. He just doesn't know it yet..Probably something to do with interstate theft.

he is probably waiting for paypal to deposit the funds into his bank account.

Based on how the OP is going about things, wouldn't be surprised if nothing comes.
