Our Attorney has asked Marion County to let us temporary operate while he explores our options for a permanent solution.

No word from county yet. We will be closed this weekend hoping to be racing next weekend.

I've read about similar cases, and in most, the county has let the track operate until the appeal had been addressed fully. I'm hoping they'll grant Dave's permission to stay open at least through this summer.

Default Update on our progress.

First off we have not had to remove the facility.

Secondly, they have not said yes but they also have not said no.

We are still working with county on a temporary operating permit. They have asked how we would handle track donations and want something in writing. Our attorney is working with them on a solution to this.
We are also working on a permanent solution at the same time.
It does not look like we will be able to race this weekend but will be looking forward to the day we can.

Another weekend rained out. 2 of the 3 weekends that we have had to be closed it has rained. Still waiting for the county to respond to our proposal.

I guess if the county drags their feet long enough, they'll get what they wanted, No Racing at Dave's. We're still holding out hope!

Update.

As of today we have spend $2400 on attorney fees.
We have been waiting for a decision from the county on our proposal. Talked with attorney last week and he doesn't see any reason why they would not approve. Unfortunately the decision maker has been on vacation for 3 weeks but came back to work last week. We hope to hear something good or bad this week.
