Default Antenna length on a 40mhz system

Its not really a big deal or anything but do I need to have my receiver antenna 10 stories high on my 3PK with the r203HF 40mz receiver?

mines about 15cm long and works fine. had to cut it due to the airel wrapping around the wheel. havnt had any problems with range or glitching at the track

Is 40mhz legal to use in America? I thought it was only 27mhz, 75mhz and 2.4ghz.
